The court has refused to send Mohammad Shariful Islam, accused of attacking Bollywood actor Saif Ali Khan, to police custody. Mumbai Police sought his two-day police custody, but Magistrate Komal Rajput said that further police custody is not appropriate at this stage. Therefore, he is sent to 14 days judicial custody. The magistrate also advised the police to read the Indian Judicial Code.
Magistrate Komal Rajput said, "You should read the first BNS. The accused has been in police custody for more than 10 days. More custody than this is not appropriate. He will be sent to judicial custody now. If something new comes out in the investigation, then after 30-40 days he can be sent to police custody again for 2-3 days." The police told the court that during the last five days they have recovered the shoes of the accused.
Ajay Lingurkar, the investigating officer in the case, said, "We have investigated and found out from where the accused bought the weapons and tools to break into the house. We have given his sample for facial recognition process. The accused is very smart. He did a recce of the area before the theft at Saif Ali Khan's house. We need his custody for further investigation and interrogation."
Investigating officer Ajay Lingurkar also said that a team of Mumbai Police is in Kolkata to find out how the accused entered India and how he sent money to his family in Bangladesh. The accused's lawyers Sandeep Sherkhane and Dinesh Prajapati argued against police remand. The magistrate refused to give immediate custody to the police after reviewing the investigation so far.
