Manish Sisodia Remand: 'One phone...', what happened in the court today in Manish Sisodia case? Read the argument of CBI and Deputy CM

Manish Sisodia Arrest: Delhi's Deputy Chief Minister Manish Sisodia appeared in the court on Monday. The CBI sought a five-day remand of the Deputy Chief Minister, which was opposed by Sisodia's lawyer.


Manish Sisodia Arrested: The CBI on Monday (February 27) presented Delhi's Deputy Chief Minister Manish Sisodia in Rouse Avenue Court. CBI demands 5 days custody of Manish Sisodia. Rouse Avenue Court has sent Manish Sisodia to CBI remand till March 4. Sisodia was arrested by the investigating agency on Sunday after about 8 hours of questioning in the liquor policy case. Let us tell you what happened during the hearing in the court.

The CBI said in the court that Manish Sisodia ran the cabinet note. In which public response was taken for the new excise policy. After that there was talk of making changes for retail and wholesale shops through the Group of Ministers. Seeking remand, the CBI said that the conspiracy was hatched in a very well-planned and secret manner. 

What did CBI say?

The CBI said that we got the notes of the Group of Ministers from a computer. The commission was suddenly increased from 5 to 12 crores. If the policy was correct then it had to move forward. We made two public servants accused. Indo Spirit was benefited at the behest of Manish. Judge asked why PC is needed? The CBI said that face-to-face interrogation has to be done in this matter. 

Sisodia's lawyer protested

Senior advocate Dayan Krishnan, appearing for Manish Sisodia, opposed the CBI's argument. He said that the CBI does not have any major reason to seek remand. The phone about which CBI is talking. When I changed my phone why didn't I delete my chat and call records for future investigation against me?

He said that Vijay Nair is mentioned in the chat received from the phone of Dakshin Group, he is on bail, then how is he related to Manish? The grounds of remand do not stand in the eyes of the law. Commission percentage increased with the approval of LG. The CBI said that Manish Sisodia could not answer the change in the percentage of the commission. 

"Cooperated fully with the investigation"

Manish Sisodia's lawyer said that as far as cooperation in the investigation is concerned, Manish has cooperated fully so far. The LG, who is the complainant in the case, himself approved the changes in the liquor policy. They say Sisodia used four phones, out of which three were destroyed? So what should I do? Keeping those phones safe in the hope that the agency would come and arrest them? It would not be appropriate to give remand on these grounds. 

"It is necessary to follow CrPC 41"

He said that three notices were given during the investigation, out of which two joined the inquiry, but alleged that they were not responding. If you don't answer as CBI wants, then CBI wants remand. CrPC 41 must be followed. While arresting, the police should be told the reason for this. If CrPC 41 is not followed then bail must be given. 

"Transparency was taken in liquor policy"

Manish's lawyer said that before arresting the investigating officer should think what is its purpose and what will be achieved by it? The powers of arrest must be used judiciously. Sisodia's second lawyer Mohit Mathur said that the liquor policy was kept in the public domain by Sisodia, transparency was maintained. All this was implemented only after reaching the office of the Lieutenant Governor. 

He said that whatever changes were made in relation to profit in the liquor policy of 5 to 12 percent were part of the note that was sent to the LG, in which no change was suggested by the LG then. The CBI wants to investigate the decision which was taken by the cabinet of the elected government. This cannot be.

"We need to inquire about that phone"

CBI said that we have to inquire about the phone that Manish Sisodia was using since the year 2020, January. Manish's lawyer said that the CBI had searched Sisodia's house and office on 17 August 2022, Sisodia had handed over his phone to him on 1 September 2022. This shows that he always cooperated in the investigation. The CBI gave notice to join the investigation, that too when preparations were being made to present the budget in Delhi. I sought time from CBI. I have fully cooperated with the CBI in the investigation.
