Supreme Court gives big relief to Nupur Sharma; Transfer to Delhi by adding all FIRs

In a major relief to Nupur Sharma, the Supreme Court on Wednesday combined all the FIRs lodged against the suspended Bharatiya Janata Party (BJP) spokesperson. The Supreme Court also ordered transfer of all FIRs to New Delhi and said that the High Court was an efficient constitutional body to deal with requests for quashing them. The bench was headed by Justice Surya Kant and Justice JB Pardiwala.

 

During the hearing, senior advocate Maninder Singh apprised the court that despite the stay during the previous hearing, Sharma had received summons from West Bengal and fresh FIR was registered against him in the state. He requested that the court club all the FIRs in Delhi.

 

Senior Advocate Maneka Guruswamy, appearing for West Bengal, opposed this and questioned how an accused could be allowed to choose jurisdiction, to which Advocate Singh argued that the Delhi Police FIR was a comprehensive FIR, and The investigation should be done after the first FIR was registered. 

 

SC registers all FIRs against Nupur Sharma

 

Noting that after its previous July 1 order denying relief to Sharma 'some more incidents happened', the SC said, "The broadcast of May 26, 2022 led to the registration of various FIRs against the petitioner in different parts of the country." We are consolidating the FIR in view of the grave circumstances. We were of the view that it is the job of the High Court to quash the FIR."

 

Taking cognizance of the threats against him, the SC said, "Though the petitioner was initially charged with availing the alternative remedy with reference to his first prayer for quashing of the FIR on 1st July, we are of the view that Delhi A part of the action has arisen in the U.S. and he is free to approach the Delhi High Court for quashing the FIR. An FIR has been registered in Maharashtra and a similar FIR has been registered by the IFSC unit of Delhi Police. Since this court had already taken cognizance of grave danger. We direct that all the FIRs be transferred and clubbed to Delhi Police for the purpose of investigation."

 

The Supreme Court rejected the request to oversee the process, saying it would put undue pressure on the investigating agency. In the last hearing, the Supreme Court had directed, as an interim measure, that no coercive action be taken against Nupur Sharma till August 10. The suspended BJP leader approached the apex court and appealed to club all the FIRs registered against him.
